1. General
These Terms and Conditions apply to all purchases of artworks, prints, commissions, and other products from gregersenstudio unless otherwise agreed in writing.
By placing an order, the customer accepts these Terms and Conditions.
2. Products
gregersenstudio creates and sells original artworks, limited edition prints, and commissioned works.
Original artworks are unique pieces unless otherwise stated. Limited edition prints are produced in restricted quantities as specified.
Due to differences in screen settings and the handmade nature of the artworks, slight variations in color, texture, and detail may occur.
3. Prices
All prices are stated in DKK (or relevant currency) and include VAT unless otherwise specified.
gregersenstudio reserves the right to change prices without prior notice. The price valid at the time of purchase is the applicable price.
Shipping costs are added separately unless otherwise stated.
4. Orders and Payment
Orders may be placed via the website, email, or other written agreement.
Payment must be made using the payment methods provided at checkout or as otherwise agreed in writing.
For commissioned works, gregersenstudio reserves the right to require up to 100% upfront payment before work begins.
An order is considered binding once payment has been received.
5. Delivery
Delivery times vary depending on the specific artwork and will be communicated at the time of purchase.
Gregersenstudio ships within Denmark and internationally upon agreement.
The risk of loss or damage transfers to the customer upon delivery.
In the event of transport damage, the customer must notify both the shipping carrier and gregersenstudio without undue delay.
6. Right of Withdrawal (Consumers)
Consumers have the right to withdraw from their purchase within 14 days of receiving the artwork, in accordance with applicable consumer protection laws.
The right of withdrawal does not apply to:
- Commissioned works
- Custom-made or personalized artworks
- Artworks created according to the customer’s specific requirements
To exercise the right of withdrawal, the customer must notify gregersenstudio in writing within the 14-day period.
Returned artworks must be sent back at the customer’s own expense and risk, in their original and undamaged condition.
Refunds will be processed within 14 days after the returned artwork has been received and approved.
7. Commissioned Works
For commissioned artworks, a separate written agreement will outline:
- Price
- Size and format
- Materials and color palette
- Estimated delivery time
Upfront payments are non-refundable once work has commenced.
Minor adjustments may be agreed upon during the process. Significant changes requested by the client may result in additional charges.
Unless otherwise agreed in writing, all intellectual property rights remain with the artist.
8. Copyright and Intellectual Property
All artworks are protected by copyright law.
The purchase of a physical artwork does not transfer copyright or reproduction rights to the buyer.
The artwork may not be:
- Reproduced
- Copied
- Digitized
- Used commercially
- Used for marketing or branding purposes
without prior written consent from gregersenstudio.
Gregersenstudio reserves the right to photograph and use images of sold artworks for portfolio, marketing, exhibitions, and promotional purposes, unless otherwise agreed in writing.
9. Complaints and Defects
Consumers are entitled to a 2-year statutory right to complain under Danish Sale of Goods legislation.
Complaints must be made within a reasonable time after discovering a defect.
The right to complain does not cover:
- Normal wear and tear
- Improper handling or installation
- Incorrect storage
- Damage occurring after delivery
10. Limitation of Liability
Gregersen Studio shall not be liable for indirect losses, consequential damages, or loss of profit.
Any liability is limited to the purchase price of the artwork in question.
11. Personal Data
Personal data is processed confidentially and used only for:
- Order processing
- Delivery
- Customer service
Personal information will not be shared with third parties except where necessary for delivery (e.g., shipping providers) or required by law.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by Danish law.
Any disputes shall be settled by the Danish courts.
